In Arizona,
a small estate can be transferred without the need for a probate
proceeding. There are certain limitations on the size of the estate,
the time period during which the transfer can occur, the person(s) who are
eligible to conduct the transfer, and the documents required to complete
the transfer.
A small
estate is one in which the value of all personal property does not exceed
fifty thousand dollars ($50,000.00) and the value of all real property
does not exceed seventy five thousand dollars ($75,000.00).
For
personal property, thirty (30) days after death must elapse before the
process can be completed.
For real
property, six (6) months after death must elapse before the process can be
completed.
Each
procedure involves the preparation of a special affidavit. In some
cases the affidavit is filed in a certain location and in other cases the
affidavit may be delivered to a third party
